The Appellant lost in both Land Application No. 56 of 2009 before the District Land and Housing Tribunal of Kinondoni, and in Land Appeal No. 13B of 2011 before the High Court, Land Division. Thereafter, the applicant lodged an application for leave to appeal to the Court, but later withdrew it. Then subsequently, the urge to pursue again the matter got the better of her, she applied for extension of time within which to apply for leave. This application was placed before Mansoor, J and registered as Land Appeal No. 13B of 2011 which was granted ex parte. Later, the Respondent lodged an application registered as Land Appeal No. 13B of 2011 to set aside that order, and that application was granted by Sambo, J. After the order of Mansoor, J had been set aside, the matter was placed before Khaday, and was registered as Miscellaneous Land Application No. 94B of 2013. The application was dismissed. Aggrieved by that decision, the Appellant instituted the present appeal. One of the issues before the Court was on the unique feature of the matter in the registration and numbering of the appeal as well as the applications arising from it.
