This ruling is based on the preliminary objection raised by the defendant on the propriety and competence of the suit which is pending before the court. The matter has its genesis in Civil Suit No. 117 of 2013 that was filed in the Land Tribunal at Vuga Majestic by the defendant against the 2nd plaintiff. The main issue before the court was whether or not the preliminary objection has merit.
