This was an application for the execution of the ex-parte
decision. The applicants were praying for an order allowing the arrest and
imprisonment of the person of the second Respondent/judgment debtor as a civil
prisoner. The respondents claimed that executing the decree against the second
judgment debtor would amount to violation of the cardinal principle that
directors are not liable for acts of their companies. It was in addition
pointed out that the decree was defective having been signed by the Registrar.
The Court considered the propriety of the application.
