The Appellant was appointed as an administrator of his late
father’s estate but later revoked when the Trial Court found that he lied and
forged documents he used in support of his application for appointment. The
Trial court went on to appoint another Administrator (the sister of the deceased)
to administer the estate of the deceased and distribute the estate to heirs.
The Appellant unsuccessfully appealed to the District Court. He appealed to the
High Court contending inter alia that the trial court was functus
officio to invalidate the appointment of the Appellant and that the trial
court erred in appointing a foreigner to administer the deceased estate instead
of the wife or children of the deceased.
