The Appellant was charged with and convicted of the offence
of rape by the District Court of Kilwa at Masoko. He was sentenced to 30 years’
imprisonment. His appeal to the High Court was dismissed. Aggrieved by the
dismissal he appealed to the Court of Appeal on four grounds. One that his
identification was not properly done, two, that prosecution witnesses were not
credible, three, that there were contradictions in the prosecution evidence and
four that there were irregularities relating to PF 3. The Court considered all
the complaints raised by the Appellant.
