The Appellants were prosecuted for armed robbery and convicted by Iringa Primary Court. They were aggrieved and appealed to Iringa District where their appeal was dismissed. They also appealed to the High Court but their appeal was once again dismissed. The Appellants were not daunted by the dismissals of their appeals as they appealed to the Court of Appeal of Tanzania. Before their appeal was heard the counsel for the Respondent/Republic raised a preliminary objection that the appeal was incompetent as the Appellants had not sought and obtained a certificate in the High Court that a point of law was involved as required by section 6(7)(b) of the Appellate Jurisdiction Act [Cap 141 R.E. 2002]. The Appellants contended that they did not know that the law demands such a certificate.
