The Appellant in this case sued the Respondent on his own name at Ubiri Ward Tribunal for rejecting to hand over a plot of land that belonged to Ubiri Mosque, which was entrusted to the Respondent as caretaker until the time the Mosque would be ready for construction. In both the lower tribunals, it was decided that the Respondent should hand over the plot of land, but the Appellant should pay compensation to the Respondent for the improvements made on the land. Aggrieved with the decisions, he appealed to the High Court, which raised suo motu the issue of the propriety of the Appellant to sue in his own name over a property of the mosque.
