The Appellant filed in the District Land and Housing Tribunal an application to be allowed to file his appeal out of time. The main reason in support of the application was that he was bereaved hence could not process his appeal. The Respondent protested his application but at the end, the Applicant was granted extension of time to file his appeal within fourteen (14) days. The Appellant did not file his appeal as per the Tribunal’s order. He filed another application for extension of time to file his appeal contending that he had been sick and had thus failed to file his appeal within 14 days as ordered. It was held that the application as the ground for the delay had not been proved, hence this appeal.
