The Applicant was not satisfied with the decision of the High Court and filed an application in this Court seeking for leave to appeal to the Court of Appeal of Tanzania. His application for leave to appeal was dismissed with costs for non-appearance and want of prosecution. The Applicant has filed this application seeking for a restoration order. His application is duly supported by an affidavit deponed by himself stating inter alia that his absence was not deliberate, but was occasioned by his sickness. Some photocopies of medical chits were attached to the affidavit to support his assertion about his sickness. The application was dismissed on 13th December 2007, but the dates on the medical chits were subsequent to the date of dismissal of the application. In the dismissed application, the Applicant was represented by an advocate who failed or refused to appear before the Court to represent the Applicant and as a result of this, the application was dismissed for want of prosecution.
