The Appellant was successfully sued at the trial tribunal for encroaching 6 meters into the Respondent’s land. The Appellant did not appear on the date set for the mention and the Tribunal ordered the matter to proceed ex-parte against the Appellant. An attempt to set aside the ex-parte judgment was denied hence this appeal. On appeal, it was discovered that the Respondent had failed to prove her case to the required standard.
