The Appellant was sued by the Respondent at Vuga Bazo Ward Tribunal for recovery of a piece of land. The claim before the Ward Tribunal was that the Appellant had trespassed on the Respondent’s land. Both the trial tribunal and District Land and Housing Tribunal on appeal ruled in favour of the Respondent. Still aggrieved with the decision of the lower tribunals, the Appellant has decided to appeal to this Court challenging inter alia the lower tribunals’ reliance on the evidence of the Respondent’s blood brother and the decision made by the appellate tribunal of allowing the written evidence of a witness who did not testify before the Ward Tribunal.
