A District Court acquitted the accused person who was
charged with the offence of criminal trespass c/s 299 (a) of the Penal Code
although the accused did not raise the defence of autrefois acquit. The
Director of Public Prosecutions appealed to the High Court arguing that the
trial court erred in not finding that there was no proof of the plea of autrefois
acquit to the Respondent.
