The Plaintiff was a director of Kibo Management Services Limited (hereinafter called “the Company”). The Company was the tenant of the 1st Defendant. The landlord (the 1st Defendant) evicted the tenant (the Company). Consequently, the Company’s director (the Plaintiff) filed a suit in his name but not in the Company’s name. The first and second Defendants raised a preliminary objection on point of law against the suit on two grounds, firstly, the Plaintiff had no locus standi to file the suit, and secondly, there was no cause action. On behalf of the Plaintiff, it was argued that the Plaintiff being the director of the evicted tenant had suffered loss and injury and thus entitled to sue. The High Court considered whether the cause of action existed and whether the Plaintiff had the right to file the suit.
