The Respondent filed a suit against the Applicants over possession of a clan land in a primary court. Having heard the case, the primary court gave judgment in the favour of the Applicants. The Respondent was aggrieved and appealed to the District Court which reversed the decision of the primary court and declared him the winner. The Applicants appealed to High Court where the appeal was heard by a magistrate with extended jurisdiction and their appeal was once again dismissed. They filed a notice of intention to appeal to the Court of Appeal and related applications. During the hearing of the applications, the presiding judge noted that the magistrate with extended jurisdiction had entertained and determined the matter without requisite jurisdiction. He then proceeded to forward the records to the Court of Appeal for revision.
