The Appellant was charged with, and convicted of, the offence of murder. He was consequently sentenced to suffer death by hanging. The immediate circumstances attending to the death of the deceased was uncertain and two versions existed, one pointing to the guilt of the accused and the other to his innocence were possible. Dissatisfied, he appealed to the Court of Appeal.
