The Respondent instituted a suit in Mbaramo Ward Tribunal against the Appellant for recovery of the farm in dispute. The trial tribunal decided the dispute in favour of the Appellant. Aggrieved by that decision the Respondent lodged the appeal in Korogwe District Land and Housing Tribunal. The appellate tribunal reversed the trial tribunal’s decision on the ground of adverse possession. The Appellant was aggrieved with the decision of the appellate tribunal, hence preferred this appeal. The issue was whether the appellate tribunal was correct in invoking the doctrine of adverse possession in favour of the Respondent.
