A villager, Ochuodho Riaki, secured a loan from the Respondent by mortgaging his land. He failed to repay the loan in time and thus an agreement was reached to sell the land to the Respondent. Immediately after the sale, the Appellant, a member of Kawino clan, filed an application in Rocha Ward Tribunal objecting the sale of the land to the Respondent on the ground that it belonged to Kawino clan. The Rocha Ward Tribunal gave judgment to the Appellant. The Respondent appealed to the Tarime Land and Housing Tribunal which reversed the decision of the Rocha Ward Tribunal on the ground that the Appellant had no authority to represent all clan members without their explicit approval. The Appellant was aggrieved and appealed to the High Court. The main issues before the Court were whether Ochuodho Riaki had a good title to the land which he sold, and whether the Appellant had locus standi to represent all clan members.
