The Appellant was prosecuted jointly with Ernest Shitegwa for corruption offences under the Prevention of Corruption Act, No. 16 of 1971 as amended from time to time in Kahama District Court Criminal Case No. 198 of 2005. At the end of the trial the Appellant and Ernest Shitegwa were acquitted. Following his acquittal, the Appellant then filed the suit in the High Court for malicious prosecution which was dismissed. He then appealed to this court.
