The Applicant applied for extension for leave to appeal to
the Court of Appeal after a similar application was struck out because it was
accompanied by a defective affidavit. The Applicant contended that it was not
served with notice of the date of the delivery of the Ruling striking out its
application but as soon as it became aware of it, it immediately set upon
processes of the application seeking extension of time in which to apply for
leave to appeal after refusal by the High Court. The Respondent resisted the
application stating that no sufficient cause had been shown because the delay
was a mere laxity and negligence on the part of the Applicant.
