The Appellants were convicted of Armed Robbery and sentenced to thirty years’ imprisonment each in the District Court of Temeke. They preferred a joint Criminal Appeal No. 113 of 2007 to the High Court of Tanzania. Their appeal was found to be devoid of merit and dismissed. Undeterred, they filed a second appeal, Criminal Appeal No. 249 of 2009, in this Court which was also dismissed for lack of merit. The applicants lodged a Notice of Motion in this Court in which they prayed for extension of time within which to lodge an application for review of a judgment delivered by this Court against them on 10th April, 2011. The Notice of Motion was supported by an affidavit purportedly jointly deposed by two persons who did not indicate their respective names, but their identities as “we applicants”. The unnamed applicants signed the joint affidavit by impressing their respective thumbprints and described themselves as “1st applicant” and second applicant respectively. The application also contained the affidavit of one A 9420 Sergeant Dastan of Ukonga Central Prison, but this affidavit was not signed by the said Sergeant Dastan, and was also not dated.
