The Applicant, an employee of Bagamoyo District Council
authority, was first transferred to Mbulu District Council later, to the
Kisarawe District Council. After he had reported at his new work station, he
was recalled to Mbulu District Council to answer charges of financial
mismanagement committed during his tenure of office in the Mbulu District
Council and interdicted. The Minister for Local Government terminated his
service which termination was confirmed by the President of the United Republic
of Tanzania. The Applicant applied for an order of certiorari to quash
different decisions relating to his termination from local government service.
He also sought an order of mandamus to issue to reinstate him to his
former employer.
