The Appellant sued the Respondent in the Land Tribunal Civil Suit No. 70/2013 for trespass. It was the Appellant’s case before the Land Tribunal that the Respondent has invaded his plot of land by demolishing his house foundation and then erecting upon it a hut. It was his further claim that he had bought the plot in dispute from one Zaina Khamis Juma who had been granted the same by the Government vide a certificate of a right of occupancy. The Respondent categorically denied the Appellant’s claim stating that the plot in dispute does not belong to the Appellant but it is hers since 1993. The Tribunal dismissed the Appellant’s suit on several grounds. The findings and the decision by the Land Tribunal dissatisfied the Appellant who has filed this appeal.
