The High Court of Zanzibar made orders including one dismissing the suit before it without inviting counsel of both sides to address it. The Court also did not resolve certain applications in the nature of preliminary objections which were filed before it. On appeal, the Court of Appeal of Tanzania invited counsel of both sides to address it on the irregularities of the proceedings before the High Court. Both counsel submitted that the proceedings were strange and without legal basis. They invited the Court of Appeal to exercise its revisional power to nullify the proceedings.
