The Appellant charged with unlawful possession of elephant meat, which is a Government Trophy under the Wildlife Conservation Act No. 5 of 2009 (WCA). This possession was contrary to sections 86 (1), 2 (b) of the WCA read together with paragraph 14 (d) of the First Schedule to and section 60 (1) and (2) of the Economic and Organized Crimes Control Act [Cap 200 R.E. 2002]. The trial court found the Appellant guilty as charged. He was convicted and sentenced to serve 15 years’ imprisonment. The Appellant preferred an appeal to the High Court at Iringa, his first appeal was dismissed. In his second appeal the Appellant preferred five grounds of appeal which boil down to the contention that the prosecution’s case against him was not proved beyond reasonable doubt.
