The Applicant filed a chamber application supported by an Affidavit asking the High Court to extend time for appeal. He cited ignorance of procedure to appeal and financial difficulties as factors, which prevented him from appealing in time. Further, he stated that he had to travel from Lindi to the Prime Minister’s Office, in Dar es Salaam, in order to complain about the judgment where he was educated about the procedure of appeal. The Respondent countered by arguing that ignorance of law and financial difficulties cannot be good grounds to warrant extension of time to appeal. He also argued that the Applicant wasted time by resorting to political solutions instead of appealing according to the law. The Respondent also attacked the Application by arguing that the affidavit that supported the Application was defective as its jurat did not bear the stamp of the Commissioner for Oaths. On its part, the High Court noted that the Applicant did not cite any provision under which the Application was made.
