The Appellants were charged with and convicted of armed robbery in Arusha District Court. They were sentenced to thirty years’ imprisonment and ordered to pay compensation to the victim. The Appellants’ appeal to the High Court was dismissed in its entirety and thus decided to appeal to the Court of Appeal. Before the Court of Appeal, they argued that the Complainant was not a credible witness; prosecution’s evidence was contradictory and that the caution statements were illegally recorded. The Counsel for the Respondent (Republic) fully supported their conviction and argued that they were properly identified and that the statements were properly recorded by the Police.
