This application originates from the fact that, the
Respondent instituted a petition against the applicants in the High Court. The
matter was placed before Mruma. J., for hearing. Before hearing commenced, the
Principal Officer of the first applicant filed an affidavit on behalf of all
other applicants to the effect that, they have lost confidence in the presiding
Judge and requested him to recuse himself from the conduct of the case. The
presiding Judge refused to recuse himself from the conduct of the case.
Dissatisfied, the applicants lodged the present application moving the Court to
invoke its revisional jurisdiction and call for the proceedings as well as the
impugned Ruling and Drawing Order to satisfy itself as to its correctness,
legality, proprieties and quash and set it aside. The Respondent raised
preliminary objection challenging the competence of the application.
