The two parties in this case are half-brothers. They share the same father, the late Abdillah Bakari. The Appellant is the current administrator of the estate of their father. The two of them are locked up in a dispute over the ownership of a house situate on a plot of land in Lindi Township. While the Appellant maintains that the suit property is part of the estate of their later father, the Respondent claims to be the owner thereof, having been given the same by the father when he was still a child. The Respondent filed a suit before Lindi District Land and Housing Tribunal challenging the inclusion of the disputed property in the estate of the late Abdillah Bakari. His position is that the deceased built the house for him as a sole owner thereof. Juma Abdillah Bakari who was the first Administrator of the deceased estate, testified that the suit property belonged to the late Abdillah Bakari, which was why he included it in the deceased’s estate. Trial ensued and, at the end, the Tribunal declared the Respondent the lawful owner of the suit plot. The Appellant was dissatisfied with the decision, hence this appeal.
