This appeal arises from the judgment of the High Court at
Moshi against the Appellant for repayment of monies advanced as loans, interest
thereon, punitive damages, general damages and costs of the action. In its
judgment the High Court ordered the Appellant to refund the Respondent unpaid
loans amounting to US$ 1,100,000.00, interests thereon, general damages in sum
of Tshs. 100,000,000.00 and costs. The court dismissed the Respondent’s claim
for an award of Tshs. 100,000,000.000 as punitive damages. Feeling that justice
was not rendered, the Appellant now appeals to this Court.
