The Appellants were charged with various counts of simple theft, theft by servant, conspiracy to defraud and forgery before Kigoma District Court. They were convicted and sentenced to terms of imprisonment. They were aggrieved by the decision and appealed to the High Court arguing that they had no fraudulent intent and that they had a bona fide claim of right. The major question before the Court was whether there was evidence to ground the conviction.
