The Appellant was charged with the offence of murder
contrary to section 196 of the Penal Code [Cap 16 R.E. 2002]. The allegations
being that on the 29th March, 2012 around 11.30 hours at Mihuga
village, within Bagamoyo District in Coast Region, the Appellant murdered one
Ester Petro, the deceased. After a full trial the Appellant was convicted and
sentenced to be detained during the President’s Pleasure on such condition(s)
to be directed by the Minister responsible for legal affairs under section
26(2) of the Penal Code. The Appellant dissatisfied with the trial court’s
decision appealed to this Court.
